1.- Applicable regulations
The contract, whose terms and conditions must be fulfilled by both parties, consists of the clauses included in the General Terms and Conditions published in this programme/brochure, and they complete and develop the specific applicable regulations without contravening it. The specific stipulations agreed between the Agency and Consumer are also included. All of this makes up a “travel package” contract, as it includes a set of services previously scheduled and offered for a global price or designed at the customer's request for a global price. By acquiring or taking part in the package referred to in the programme/brochure, the consumer expressly accepts each and every one of the General Terms and Conditions, which are considered automatically to be incorporated into the contract, without the need for their individual transcription therein.
2.- Organiser
This travel package has been designed by VIAJES BAQUEIRA BERET, with Tax ID No. A-25051053 and registered address at Acores s/n, 25598 Salardu, Title - licence GC-26 MD.
3.- Registration
When making your booking and having chosen to defer the payment of the total amount, you must provide a valid credit card number to pay the deferred amount or the corresponding cancellation costs if cancelled, according to these terms and conditions.
In order to guarantee your data's security in digital transactions, Viajes Baqueira / Baqueira Beret employs the tokenisation system for your card. We will never store the card details, but we will generate an encrypted link to your bank where we can only charge you the amount of the operation accepted in your booking confirmation.
Automatic cancellation
To make a booking, you will have to pay a deposit within 48 hours; if we do not receive this payment, the booking will be automatically cancelled. This automatic cancellation will also be executed on the date which cancellation costs start being generated.
The booking will be confirmed by email. The customer will receive the documentation corresponding to the ski passes and meals on the slopes at the accommodation reception desk via the Express Delivery service. You can see how to redeem the rest of services you have contracted

If a customer makes a booking after 2:30 pm of the day before arrival at the accommodation, they must pick up the ski passes and documentation at the Baqueira 1500 Information offices.
4.- Invoicing
All invoices issued by Viajes Baqueira Beret S.A.U. will include VAT, in accordance with the Special scheme for travel agencies. If you would like to receive your invoice issued with the VAT broken down in accordance with the General scheme, you must request it by email at viajes@baqueira.es before the start date of your contracted service/stay. Once the invoice has been issued, it cannot be amended with a change in the VAT Scheme (Article 52 of Royal Decree 1624/1992 of 29 December).
5.- Cancellations, refunds or amendments
If you wish to cancel the booking, contact Viajes Baqueira Beret.
Customers can withdraw from the requested or contracted services, and they have the right to the refund of the amounts paid, whether it is for the full price or the deposit previously provided. However, they must compensate the Agency, as a penalty, for the cancellation costs arising from the accommodation and other additional services. The date on which cancellation costs start being generated and the amount to be paid will be set by each provider (these can be consulted at the time of booking).
No refund will be made for services contracted and not used voluntarily by customers. After the ski passes have been issued, they cannot be cancelled within 24 hours of the date of arrival.
Skiing is a tourism-sports activity that takes place out outdoors, in high mountains, and can be affected by adverse weather conditions. This may force the partial closure of the resort. If this were the case, the contracted services would not be refunded, unless there is a total closure of the resort. Services will be refunded following an accident ONLY when the ski passes include the accident insurance offered by Baqueira. Customers must present the corresponding medical certificate and hand over the ski pass within 24 hours. We will check if the ski pass has not been read at any control point in the days following the accident, and we will proceed to refund the proportional part corresponding to the ski pass days not used.
6.- Important aspects about the ski pass
The ski passes taken out are for unlimited use of ski lifts in Baqueira Beret ski areas that are open at that time, according to the days requested. The ski pass days are consecutive and may never exceed the number of nights of accommodation contracted by more than one.
The basic price does not include the accident insurance that covers skiing. Please view the optional ski accident insurance policy, the validity period of which must match the period of skiing days.
7.- Important aspects about hotels and apartments
The current legislation establishes the official tourism category and the existence of single and double rooms. In some of the latter, a third or fourth bed can be provided, considering that the use of this bed is always carried out with the knowledge and consent of the people occupying the room. This consideration arises from the fact that it has been previously warned and that the room is shown as a triple or quadruple room in all the booking documents and in the final package documentation. View the check-in times for hotels and apartments/houses on the website. Please inform the accommodation if you are planning to arrive after 9:00 pm.
Animals are not permitted in hotels or apartments, unless expressly authorised by the establishment. Complementary services and facilities (garage, gym, Jacuzzi, spa, sauna, etc.) available in some establishments are published for information purposes only and, unless otherwise specified, must be paid for directly when used.
When renting apartments, the customer is fully and exclusively responsible for correctly declaring the number of people occupying the apartment, without omitting children of any age. The apartments' management may refuse to admit the access of people who have not been declared, with no possibility of submitting a claim for this reason.
The total number of places in an apartment or chalet/house corresponds to the number of available beds, including double beds, bunk beds, sofa beds and single beds. In some cases, extra beds or cots can be provided when requested by customers and will not be included in the published price. Customers must make a deposit at the apartments' reception to cover any possible damage. The apartments are ready to be occupied with linen and household items corresponding to the number of reserved spaces. View the cleaning services of each establishment on the website. The Apartarent apartments in Nin de Beret/Floc de Neu and Ruda and the chalets/houses do not include electricity and heating consumption, which will be invoiced at the customer's check-out. The keys must be collected at office hours at the place and time specified in the brochure of each establishment.
Apartment deposits: Check the deposit required by each apartment to cover unexpected damage or cleaning. In the event of unforeseen circumstances that prevent occupying the selected apartment, the user will be relocated to an apartment of the same characteristics, without the right to receive any kind of compensation or indemnity.
Several of our accommodation options do NOT allow making any modifications to confirmed bookings. Any requested modification requires fully cancelling the booking and making a new one, which will preferably be carried out by the customer directly on the website. This new booking made on another date may involve a different rate or availability option. We recommend that you review the specific terms and conditions of each accommodation option shown before confirmation, especially the cancellation and modification conditions.
8.- Terms and conditions and redemption of activities
You can view the terms and conditions and instructions for the various activities offered, such as parking, lessons, equipment rental and other activities, at https://reservas.baqueira.es/es/canjear-servicios.html.
9.- Special terms and conditions for children
Given the variety of ways of treating children, according to the age, type of establishment and date of the travel package, we recommend checking the terms and conditions of each establishment, which will generally be applicable if the child shares a room with two adults.
Children under 6 and adults over 70 can obtain a ski pass at a special price, if they previously certify their age via an official document (family book, ID or passport).
The child ski pass is for children between 6 and 11 years old, both inclusive. The age on 31 December of the year in which the season starts will be considered.
9.- Liability
The Travel Package's Organising and Selling Travel Agencies will be liable, in the corresponding proportion, for the obligations they undertake within their scope of managing the Travel Package when it comes to the appropriate execution of the obligations arising from the contract with the consumer. This applies regardless of whether these obligations must be executed by them or other service providers and without prejudice to the right of the Organising Agency to take action against them, always within the limits established in the General Terms and Conditions and in the applicable regulation. If the consumer experiences in situ the poor execution or non-execution of the contracted services part of the package, they must immediately notify the provider and, within 48 business hours, the Organising Agency, so that the latter can take the necessary measures. Failure to notify the Organising Agency will entail the consumer having to prove the non-compliance in the contract's execution before the Organising Agency or the General Directorate of Tourism and/or the relevant Court, as it would be impossible for the Organising Agency after the aforementioned deadline to verify that alleged by the consumer and to provide a satisfactory solution for all the parties involved.
If the proposed arrangement does not satisfy the customer, they may file a claim before the Organising Agency through the Selling Agency within one month of the date of return, certifying the submission of the claim within 48 business hours of it having taken place. However, submitting a claim related to the contract will not exempt from the payment of the package.
All prices published by Viajes Baqueira Beret are official prices, except for typographical errors.
10.- The parties agree to submit any dispute regarding the interpretation, application or execution of the provisions contained in this document, in particular those arising from an accident, to the jurisdiction of the Court of Vielha.
Warning: The contracted services and their terms and conditions are subject to amendment in accordance with any public health guidelines that may be established at any given time.
11.- Validity
The programme is valid from 26 November 2024 to 21 April 2025, and it has been published in August 2024.

The legal representative, or person delegated by the latter, having sufficient authority to do so, agrees to the use of the data corresponding to the child in whose name the booking is made and the capture of images during the activity under the above terms.
12. Free Ski Lift Car Park service for accommodation + ski pass bookings
In order to enjoy the free Ski Lift Car Park service included in the accommodation + ski pass packages, you must request the service when making the booking and provide the number plate of the car with which you will access the car park.
IMPORTANT
Make sure you have correctly entered your number plate when making the booking.
If you do not know the number plate at the time of booking or you finally decide to go to the resort with another car, send an email to reservas@baqueira.es indicating your booking locator and the new number plate.
If we have not received the vehicle's number plate at least 24 hours before the entry to the car park or the number plate does not match the one on the booking, THE FREE SERVICE WILL BE CANCELLED and the corresponding amount must be paid to remove the vehicle.
The free Ski Lift Car Park service is only for bookings of accommodation + ski pass directly made through Reservas Baqueira Beret. The number of days of the car park service is set to the number of days of the ski pass, not the accommodation.
Maximum height allowed for cars: 2.30 m
Limit of parking spaces for bookings including people with ski pass.
- 1 car: 1-4 people with ski pass
- 2 cars: 5-8 people with ski pass
- 3 cars: 9 or more people with ski pass

13.- Specific terms and conditions of activities
13.1. Activities provided by MONTGARRI OUTDOOR S.L.
The company reserves the right to charge a deposit of €500 for each snowmobile booked for the snowmobile activity. This deposit will be charged using a POS terminal. If the snowmobile shows no damage, this amount will be released after 1 week.
CANCELLATION CONDITIONS
BOOKINGS INCLUDING ONE OR TWO SLEDS AND/OR ONE OR TWO SNOWMOBILES
Weekends, long weekends, public holidays and high season:

Weather conditions:
If weather conditions prevent activities from being carried out in safe conditions (e.g. due to the risk of avalanche), the date of the activity will be changed or the full amount of the activity will be refunded.
In any case, the provider (Montgarri Outdoor S.L.) will always decide, under its responsibility, when to cancel the activities.
If the access road to Pla de Beret is closed and the date of the activity cannot be changed, the full amount of the activity will be refunded.
If the customer cannot access Beret by their own means (snowy road conditions, no snow chains, etc.), they must notify Montgarri Outdoor S.L. at least 2 hours in advance.
In the event of snowy road conditions, if the customer decides to cancel or not attend the activity on their own accord without consulting Montgarri Outdoor S.L., the company reserves the right to charge the full amount.
Cancellation due to illness:
In the event of cancellation due to illness of a participant of legal age, the amount of the sick participant's booking will be refunded. A medical certificate must be submitted. If the rest of the companions cancel, they will be charged in full.
Children under 10 years of age: In the event of cancellation due to illness of a participant under 10 years old, the amount of the sick participant's booking plus one adult's booking will be refunded. A medical certificate must be submitted. If the rest of the companions cancel, they will be charged in full.
BOOKINGS FOR GROUPS WITH BOOKINGS INCLUDING MORE THAN TWO SLEDS AND/OR MORE THAN TWO SNOWMOBILES
These groups have specific cancellation conditions.
Conditions for groups
MORE THAN TWO SLEDS
- No date changes are permitted
- 20 days in advance: 100% penalty
- 30 days in advance: 75% penalty
If the booking is made less than 20 days in advance and is cancelled, a penalty of 100% will always be applied.
The booking's terms and conditions are based on the Montgarri Outdoor's rates for the 2022/23 Winter Season.
To enjoy any activity provided by Montgarri Outdoor S.L., the customer must accept the booking's terms and conditions.
For group bookings of more than nine people, 50% of the activity's amount must be paid 60 days before the event takes place. The remaining 50% must be paid 30 days before the event.
A place will be considered reserved and confirmed when the customer pays 100% of the contracted activity's cost.

Important remarks
Montgarri Outdoor S.L. understands that our customers are aware that they are contracting an outdoor adventure activity in the mountain.
To carry out our activities, Montgarri Outdoor S.L. expects our customers to be informed of the typical high mountain weather conditions, where temperatures can often be below zero degrees Celsius, there is poor visibility and they are exposed to mishaps and adversities related to meteorological conditions.
Equipment for mountain or ski activities (anorak, waterproof trousers, gloves, hat, sunglasses, etc.) is required to enjoy our activities.
Montgarri Outdoor S.L. understands that the customer is aware of the points outlined above and that they participate voluntarily in our activities. When contracting the activities offered by Montgarri Outdoor S.L., the customer accepts all the aforementioned points.
IN THE EVENT OF AN ACCIDENT
Montgarri Outdoor S.L. holds a civil liability insurance and a personal accident insurance policy, both of which are legally required (Decree Law 56/2003 of 4 February of the Government of Catalonia).
Montgarri Outdoor S.L. holds the municipal licence issued by the Naut Aran City Council to carry out all its activities.
Accidents with and damage to snowmobiles
In the event of an accident due to the snowmobile driver's negligence, they will be liable for any damage caused to the snowmobile (or vehicles involved).

13.2. Pyrenees-heliskiing: Heliskiing and Panoramic Flights
CHANGES AND CANCELLATIONS
Cancellations must be confirmed in writing. The “CANCELLATION DATE” will be whenever PH receives the cancellation confirmation. The next day will be considered for Saturdays, Sundays and public holidays. If the cancellation date is prior to 1 December, PH will return the balance of your account less the initial deposit. Once the initial deposit is made, it will not be returned under any circumstances. There are no refunds of any kind for cancellations made after 1 December.
CHANGES AND CANCELLATIONS BY PH IN NON-HELITRANSPORTED PROGRAMMES
In the event of cancellation or modification of your booking (snowshoeing, freeride, ski mountaineering and skiing) due to adverse weather conditions, PH will assign you a provisional date according to availability and will maintain the total amount of your booking for a maximum period of 1 year. If you would like to request a refund, PH will charge 20%/pax of the total amount as administrative costs. The administrative costs will not be covered by the cancellation charges insurance.
CHANGES AND CANCELLATIONS BY PH IN 1/2 DAY, 1 DAY AND PRIVATE PROGRAMMES DUE TO ADVERSE WEATHER
In the event of cancellation or modification of your booking due to adverse weather conditions, PH will assign you a provisional date according to availability and will maintain the total amount of your booking for a maximum period of 1 year. If you want to request a refund, PH will refund you for any unrealised descents (€100/pax/descent, based on groups of 4 pax) in the Classic full day and 1/2 day programmes. The amount charged minus the corresponding administrative costs will be refunded in Private programmes:
- Groups of 3 skiers: PH will charge a sum of €770/pax, corresponding to the administrative costs and exclusive reservation of the helicopter
- Groups of 8 or more skiers: PH will charge a sum of €290/pax, corresponding to the administrative costs and exclusive reservation of the helicopter. The administrative costs will not be covered by the cancellation charges insurance
THERE WILL BE NO PARTIAL OR FULL CANCELLATIONS FOR ANY OF THE FOLLOWING REASONS: Delay in the arrival at the heliport or activity, illness, injury, lack of ability or physical condition of the customer, flight delays, presentation of travel documents that are not in order. If you cancel any programme or activity, the unused third-party services will be refunded, provided that they have not been charged to PH. In emergency cases (e.g. illness or accident of the affected person, serious illness or death of a close relative), PH staff will help organise your premature return. Please note that you can take out insurance for repatriation costs, which is not covered in the travel package's price.
